Key Things to Know

Qualifying conditions
You must have worked for your employer for at least 26 weeks by the end of the 15th week before your baby is due, and earn at least £123/week (Lower Earnings Limit 2025/26).
SMP is taxable
SMP is subject to income tax and NI like normal pay. Your employer deducts tax at source — though your income may be well below the personal allowance during leave.
You can start SMP from
The earliest you can start SMP is 11 weeks before your baby is due. SMP starts automatically if you are absent for a pregnancy-related reason after 36 weeks.
Shared Parental Leave
You can choose to end maternity leave early and share the remaining entitlement with your partner as Shared Parental Leave (ShPL), potentially getting a higher rate if their employer offers enhanced SPP.
